The acceptance of this document implies that the user:

  1. Has read and understands its contents.
  2. That the user is a person having the capacity to be able to contract.
  3. That assumes all the obligations set forth herein.

 

The present conditions will be valid indefinitely and shall apply to all contracts done through the website of the provider www.nanaandjules.com

The provider reserves the right to modify these conditions without affecting the promotions acquired previously to the modification.

Identity of the parties

On the one hand, the supplier of the services contracted by the user is Ana Julia Corrales Castro, in Malaga (Malaga), calle Montemiramar 15,29016 and customer service telephone +34609922210, (hereinafter Nana & Jule’s) and on the other hand, the user, registered on the website with a username and password, being fully responsible of the personal data provided to the provider, including the information provided on credit cards or others means of payment used during the process.

Object of the contract

The object of this contract is to regulate the contractual relationship between the provider and the user at the time the user accepts the online contractual process by checking the respective checkbox.

The contractual relationship involves the delivery of the purchase, in exchange of a certain price and publicly exposed through the website, of a product or service.

Contract procedure

The products that appear for sale on this website are offered for sale in Spain (Peninsula, Balearic and Canary Islands, Ceuta and Melilla), Europe, Latinamérica and U.S.A.

The contract procedure will be performed in Spanish. In case it can be done in any other language it will be selected before starting the contract process.

If the user wants to access the services offered by the provider, he must be registered on the website by creating a user account. For that purpose, the user will provide freely and voluntary all the required personal data.

The user will select a user name and password, committing to do a diligent use of them, and not making them available to any third party, and informing the service provider about the loss or the possible access by an unauthorized third party, so that it might be immediately blocked.

The user may not select as user name words that have as purpose to confuse others by identifying it as member of the provider, as well as offensive expressions, slanderous and in general, contrary to law or the requirements of morality and decency.

Once the user account has been created, in accordance with the requirements of Art. 27 of Law 34/2002 of Services of the Information Society and Electronic Commerce, the contracting procedure will follow the steps below:

  1. Sales Order. It will contain the breakdown of the requested products and services, where quantities of each item can be modified or even deleted. All total prices and the taxes will be shown.
  2. User Login or Register. Registration is required if it has not been done before. Registration confirmation will be sent to the email address indicated in the registration.
  3. Delivery and billing address. The delivery and billing addresses will be shown and can be modified if desired by the registered user.
  4. Acceptance of the general sale conditions.
  5. Payment method. Any of the available payment methods should be selected. In case of secure electronic payment methods, such as credit card payments, it will be directed to a secure site or external payment gateway for a safe payment. (PAYPAL)
  6. Order Confirmation. Once the order is confirmed, an email will be sent to the user´s registered email address. The contracting platform will inform the user by email, once the contract process is completed, about the price, payment method, shipping and billing address.

 

Prices, taxes and payment methods

Prices shown on all Nana & Jule’s products are in Euros (€) and include Value Added Tax (VAT). If you make a purchase from the Canary Islands, Ceuta and Melilla, no VAT will be added at the time of ordering, the recipient must pay the taxes demanded by the customs at the time of collecting the goods.

If you make a purchase from any country of the European Union, VAT will be added to the intra made unless the recipient provides an intra Tax.

On the other hand, buying from any other third country not accrue tax, being an export. In the latter case, the recipient must pay the required taxes at customs at the time of collecting the goods.

In case of any additional charges related to shipping or payment method, those will be shown in the order summary, before the payment.

The prices applicable to each product will be published on the website and applied automatically in the last stage of the contracting process. The client assumes that some prices may vary in real time, but this will be previously communicated to the users.

Any payment made to the provider will result in an invoice to the registered user name. That invoice can be downloaded by the user through the section "History and details of my orders"; within the section "My Account" in which the user can access once he has been validated in the system.

Nana & Jule’s accepts payments done by credit or debit card (Visa, Visa Electron and Mastercard), Paypal and bank transfer.

For payments done by Visa and MasterCard, through the secure payment gateway, the system will automatically verify that the credit card is enable for Secure Electronic Commerce. The issuing bank will ask for a personal identification code. The transaction will only be executed if the issuing bank has confirmed the authentication code; otherwise, the transaction will be rejected.

For payments done by bank transfer, it should be done by the user from any Union European bank and bear all the transaction expenses and full sales order amount. The user should indicate the transfer reference and sales order number, name and surname. The deadline for bank transfers will be 3 business days from the requested order and confirmed once the charge is received in the provider´s account. If within 5 business days Nana & Jule’s has not received the sales amount, the order will be canceled.

Order Delivery

The order delivery will be done at the designated user delivery address. The provider will not be liable in case of an unsuccessful delivery as a result of false information provided by the user, inaccurate or incomplete, or if the delivery cannot be done for reasons beyond the control of the shipping company, like the absence of the consignee.

Notwithstanding the above, the service provider will adopt all the measures that a diligent service provider can take in order for a timely delivery. In case it is not possible it will be done as soon as possible, trying to please the customer, so there will be no liability against the provider.

Shipping companies will do the shipments for all orders placed online.

Orders will be delivered within 2-7 working days from the order confirmation.

The shipping costs will be shown duly separated in the final sale price. For shipments to the Canary Islands, Ceuta or Melilla, the customs duties and taxes shall be borne by the end user and will not be included in the selling price.

Once the order has left the warehouse, an email will be sent to the client advising that the order has been shipped along with all the information provided by the shipping company for tracking.

The customer must notify Nana & Jule’s all non-receipt orders over 10 business days, through info@nana&jules.com account.

For any other information about orders, the user will contact customer service by phone at +34609922210 or by the email specified above. In both cases the user must indicate in the subject line or to the telephone operator, the order number assigned and indicated in the confirmation of the purchase email.

Once the user receives the order he must ensure that everything is in accordance with the request. If there is any discrepancy or issue with the order, he must contact Nana & Jule’s by email, providing his personal details, order number and detail of the matter. Within a maximum of 5 working days the provider will contact the user to solve the problem.

Exchanges and returns.  Right of withdrawal.

Once the purchase has been received if the user is not satisfied with the product, Nana & Jule’s will allow refunds within seven (7) days from the date of receipt as long as the product has not been used or damaged, except party items that must be returned in 24 horas. Nana & Jule’s does not accept exchanges or returns of items damaged or used or without original packaging, unless it is faulty.

Only changes of the size of the same product will be allowed, but no model changes. In the event that the user wants to exchange an item for another, he shall proceed to return it for a full refund and place a new order.

The right of withdrawal shall not apply to personalized products, or for hygienic reasons or other legal exceptions that are not subject to this right.

All orders subject to reimbursement must include the product return form from our website, which must be filled in and sent it on line. In case of an acceptance of the return of the items the user should print the form and attached it to the returning merchandise.

The exchange or refund may be done by mail (we recommend certified mail or with acknowledgment of receipt) to the address provided by Nana & Jule’s in the return process.

All returns should be done in original packaging and with the return form duly filled.

Upon receiving the product/s, Nana & Jule’s will verify that they are in good condition and will proceed to sending the required size if a size change had been requested or will request the bank to reverse the charge in the credit card if the user requested reimbursement. The shipping costs of the products exchanged shall be borne by the user, and in no case Nana & Jule’s will pay for any shipping.

In case Nana & Jule’s had mistakenly sent a different item than the requested, the provider, after checking the mistake, will solve the issue sending the right product and sharing the shipping costs of the wrong items after the user has submitted the proof of the return shipment costs.

For any changes and/or refunds of the orders the user must print the return form that will be on Nana & Jule’s website. After printing and filling the form, the user must attach it to the returned product. Additionally, the user shall provide to Nana & Jule’s an account number if the order has been paid by bank transfer. The account number provided must be from a bank of the country of the billing order.

Claims

No liability for damages will be accepted (including during transportation) unless the user notifies the provider by email or by phone before 7 calendar days after the date of receipt of the products.

No claims or liability will be accepted for products that differ in quantity unless the user notifies by email before 7 days from the date of such receipt.

For manufacturers that offer support services and warranties, the user accepts the obligation to contact them in case of any claim.

Liability regime

Nana & Jule’s will only be liable for any damages that user may suffer as a result of the use of the online store when these damages are attributable to willful misconduct of this company. The user acknowledges and agrees that the use of the online store, and the purchase of products offered therein are at the user sole risk and responsibility.

Nana & Jule’s will not be responsible for any damages, without limitation (i) Inferences, omissions, interruptions, computer viruses, faults and/or disconnections in the operational functioning of this electronic system or in the equipment and computers of the users due to causes unrelated to Nana & Jule’s, which prevent or delay the provision of services or navigation through the system, (ii) Delays or usage blockages caused by deficiencies or overloading of the Internet or other systems electronic, (iii) They may be caused by third parties through illegal beyond the control of the store and not attributable to Nana & Jule’s, (iv) Differences of information, documentation and/or other contents of the store that might exist between the electronic version and the printed version (v) The impossibility of providing the service or allow access for reasons not attributable to Nana & Jule’s, due to the user, third parties or force majeure.

Nana & Jule’s will not control the user’s use of the website store. In particularly, under any circumstances, does not guarantee that users use the service in accordance with the law, these General Conditions, morality and generally accepted good practices and public order, nor to do so in a diligent and prudent manner.

Security and confidentiality of data

All information provided by users of Nana & Jule’s will be used only to process purchase orders and for easier navigation and purchase of Nana & Jule’s items.

Cookies are small data files that are hosted on the user's terminal that visits our website and contain certain information about the visit. This website uses cookies only to facilitate user navigation and in any case it is possible to associate these specific cookies to personal data identifying the user or through them. The user has the possibility to deactivate the cookies.

Nana & Jule’s guarantees that the information provided by customers will not be shared with third parties or companies.

The data provided will be stored in the Nana & Jule’s server using the SSL protocol and the transmission will be in an encrypted form guaranteeing the confidentiality of them. The server automatically recognizes: the IP address, date and time of entry and exit from the site, and the downloaded files.

The personal data received will be treated in accordance with the Organic Law 15/99, of the 13th December, Protection of Personal Data and other regulations current in Spain. All products offered through the website are original, unless otherwise indicated.

The color of the products displayed on the screen may be subject to variations depending on the quality of the user's monitor. Nana & Jule’s cannot guarantee that the colors displayed on the user's monitor are the same as in reality.

Intellectual and industrial property

All website contents, unless otherwise indicated, are property of the owner of the website or third parties even the graphic design, source code, logos, texts, graphics, illustrations, photographs, and other items displayed on the website.  Equally, all trade names, trademarks or distinctive signs on the website are protected by law. The website owner does not grant any license or authorization for personal use of their rights to the user intellectual property or any other right related to the website and the services offered therein. Therefore, the user acknowledges that the reproduction, distribution, marketing, processing, and in general, any other form of exploitation by any procedure, all or part of the contents of this website is a violation of intellectual and/or industrial property rights of the owner of the website.

Use of the website

The user agrees not to do any improper use of this website as an intentional introduction of viruses, trojans, worms or any programs harmful to the Nana & Jule’s system, and not authorized access attempts to the server, devices and databases of Nana & Jule’s. Breach of this provision may entail the commission of criminal offenses typified by the current legislation.

Applicable law and jurisdiction

The activity developed through Nana & Jule’s website is subject to Spanish law, which is applicable, among others, the” Ley Orgánica 15/1999” of December 13, “Protección de Datos de Carácter Personal”, the “Ley 34/2002” of July 11, “Servicios de la Sociedad de la Información y de Comercio Electrónico”, “Código Civil” and the “Real Decreto Legislativo 1/2007” of 16 November, approving the revised text of the “Ley General para Consumidores y Usuarios” and other complementary laws.

The parties agree to submit any dispute that may arise from the provision of products or services from these Conditions to the Courts and Tribunals of Malaga.

In the event that the user’s residence is outside Spain, both parties will expressly waive to any other jurisdiction, submitting themselves to the Courts and Tribunals of the city of Malaga (Spain).
